Fairweek provides software and related services to help organizations manage workforce compliance, scheduling records, and operational communications. Features, functionality, and availability may change from time to time. We reserve the right to modify, suspend, or discontinue any part of the Services at any time.
User accounts
You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
Acceptable use
You agree not to use the Services to:
- Violate any applicable law, regulation, or third-party right.
- Send unsolicited, fraudulent, or abusive communications.
- Interfere with or disrupt the integrity or performance of the Services.
- Attempt to gain unauthorized access to the Services or related systems.

Limitation of liability
To the fullest extent permitted by law, Fairweek shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data loss, arising out of or relating to your use of the Services. Our aggregate liability shall not exceed the total amount paid by you to Fairweek in the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Fairweek and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses arising out of your use of the Services, your data, or your violation of these Terms or any applicable law.
Governing law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law principles. Any dispute arising out of these Terms shall be brought in the state or federal courts located in New York County, New York.
Changes to terms
We may update these Terms from time to time. Material changes will be effective thirty (30) days after we post the revised Terms or notify you through the Services. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.
